Form I9—Employment Eligibility Verification is mandatory for all newly hired employees to file. Employees must furnish their employees in 2021 with a Form I9 along with acceptable documents that verify their identity and authorization to work in the United States.
All employees must file and present the acceptable documents within three days of their hire. If it isn’t filed within the three day period, the USCIS may impose monetary penalties on both the employee and the employer. The penalties range from $230 to $2,292 depending on how many previous offenses there was for failing to produce Form I9.
Since Form I9 is filed year-round, don’t expect a new one from the USCIS for 2021. The agency doesn’t release new Forms I9 every year. In 2021, employees are going to file the previously issued Employment Eligibility Verification. The current Form I9 in use is going to be expired on October 31, 2022. This means Form I9 issued at the beginning of 2020 is going to be used until this date.
Content of 2021 Form I9
After Form I9 expires once it is used during the course of 2021, the USCIS is going to release the new one. Although the agency is going to release a new Form I9, it would be wrong to expect significant changes. The content of Form I9 is still going to be the same as it is. Regardless of the year whether it be 2021 or future years, employees are going to provide the following when filing the Employment Eligibility Verification.
- Date of Birth
- Phone Number
- e-Mail Address
- Social Security Number
- Citizenship or Immigration Status
The required information on Form I9 isn’t anything complicated and filing one shouldn’t take you more than five minutes. Once you’re done, the rest should be gathering the acceptable documents. Learn more about documents to present with Form I9.
On the latest edition of Form I9, the USCIS added a translator/preparer section at the bottom. This is made mostly for seasonal workers who cannot speak English. A person who assisted someone who can’t read or write in English must complete this part and include their name, address, and date of completion.
